The contract templates, clauses, insurance overviews and regulatory notes in this article are for educational and drafting reference. Sweet City Candy is a bulk confectionery distributor and does not provide legal, accounting, tax or insurance advice. Contract enforceability, catering licensing and liability standards vary by state and locality, so have a licensed attorney and a commercial insurance broker in your state review any agreement before you use it.

After almost every candy buffet there's candy left in the jars. If your contract doesn't say who it belongs to, you'll be asked at midnight, usually by a tired parent of the couple holding a gift bag. A leftover candy clause settles it in one sentence before the event.

The most common choice: the leftover candy belongs to the client, and the client provides containers to take it home. You keep the jars, scoops and equipment.

Options for the clause

OptionWhat it saysBest for
Client keeps it, client brings containersLeftovers go to the client; they supply bags or boxesMost weddings and parties
Client keeps it, you supply containersYou pack leftovers into containers you bring, for a feeFull-service packages
Venue or charity donationUnopened candy is donated, if the client agreesCorporate events
Vendor keeps unopened bagsSealed bags you didn't open return with you; opened candy goes to the clientOperators who buy a buffer stock
Whatever you choose, say who packs the candy and by when, so it fits the venue's clearance deadline. See Late-Night Teardown Clauses.

Sample wording to adapt: "Any confections remaining at the end of the event belong to the Client. Client will provide take-home containers, and Vendor will transfer leftovers into them during teardown. Rental jars, scoops and equipment remain Vendor's property." More clauses are in our candy buffet contract template; have an attorney review your final contract.

Fewer leftovers to begin with

  • Order to the guest count: about ½ lb of candy per guest is our rule of thumb; see How Many Pounds of Candy for 100 Guests?.
  • Announce the candy table once in the evening, and again before last call.
  • Use wrapped candy and ready-made favors, which guests happily take home in a pocket.
